The meeting was called to order by acting chairperson Koch at 7:00 p.m.

 

Moved by Yoerg, seconded by Bieraugel to approve the meeting minutes of 2/10/05.  Motion carried.

 

Preliminary plat, Cottage Meadows, 13 one-family residential development lots, two farmette lots and six outlots, south of Tower Road and west and east of STH 35, part of SW1/4, Section 4, T28N, R19W, Town of Troy (extraterritorial review) – Todd Bjerstedt.  Darnold explained that this preliminary plat was reviewed previously as ‘Whitfield” with the same number of lots but in a different orientation.  Bieraugel asked how far municipal sanitary sewer is from this site.  Darnold noted about one-quarter mile.  Yoerg commented that the residential lots were changed to abut the STH 35 right of way and that he preferred the out lots to abut the right of way shown in the previous plat review.

 

Bieraugel noted that he is concerned about the cost of providing municipal sewer and water service to these lots in the future and the large farmette lots.

 

Moved by Caruso, seconded by Gilbert to approve the preliminary plat of Cottage Meadows located in the Town of Troy as presented by Todd Bjerstedt.  Motion carried.

4-1, Bieraugel voting no.

 

Bieraugel explained that he is opposed to the larger lots close to the city limits due to concerns of future septic system problems and the potential costs of servicing these lots in the future.

 

Petition for annexation, 20+ acres, southeast quadrant of Carmichael Road and Stageline Road – Ban Tara, LLC and property owners.  Darnold noted that the analysis for traffic impact and wastewater treatment plant (WWTP) capacity were provided in the plan commission packets including the staff review of the traffic analysis.  Darnold reviewed the wastewater treatment plant capacity analysis noting that if the properties within the current city limits and the 22.63 acres petitioned for annexation are fully developed that about 45,000 gallons per day capacity would be available.  Bieraugel asked about the capacity demand of a possible casino and if the city had an obligation to provide sanitary sewer service to a casino, if approved.  Darnold stated that is an issue for the city attorney to address.  Bieraugel noted that according to the review that the capacity for a casino has been a wide margin of minimum and maximum projected

demand on the WWTP and that the city would have sufficient capacity to meet the maximum projected demand of the casino, if the assumption is correct that approximately 55,000 additional gallons per day would be available if 15% of the projected gross commercial area is not developed.  Darnold stated yes.

 

Brian Zeller representing Ban Tara, LLC reviewed a site plan of the area proposed for development commenting that the subdivision plan is not cast in stone, and the developers are willing to amend the plan to address concerns that the city may have.  Zeller commented that they will proceed with acquiring properties if the annexation is approved and that they will acquire two of the three properties that will remain in the town of Hudson to allow those residents to relocate and then the residences will be resold.

 

Yoerg asked about the proposed driveway proposing the right-in only access between Center Drive and Crest View Drive.  Darnold noted that the developer’s traffic analysis indicated that this access should be limited to right-in only, and the city staff agrees with that recommendation.  Darnold also noted the proposed driveway would be two-way traffic except for the westerly section which will allow east bound traffic only and not allow traffic to exit to Carmichael Road.

 

Moved by Gilbert, seconded by Caruso to recommend the annexation of the 22.63 acres as petitioned for annexation by Ban Tara, LLC and property owners.  Motion carried.  4-1, Koch voting no.  Koch noted that she is opposed to the annexation because she has visited with residents of the community, and some have expressed concern about the continued growth of the community and increasing traffic and that she does not want to consider annexations until the community is surveyed regarding their opinions about the city and the city’s comprehensive plan is adopted.

 

Yoerg commented that it will be too long to await the completion of the comprehensive plan, and the city should move ahead.  Gilbert noted that the future use has been obvious as proposed for commercial use.

 

Land reclamation / grading permit, request to remove approximately 100,000 cubic yards of fill material from a 20 acre area north of Stageline Road and east of STH 35 to use at the STH 35/Hanley Road interchange project to construct approaches and ramps – Hoffman Construction / DaMe Properties.  Darnold explained that Hoffman Construction has been awarded the bid to construct the STH 35 / Hanley Road interchange.  Darnold noted that he spoke to several contractors, just before the bids were due to WisDOT, vying for the contract about the need for fill to construct the ramps and approaches; all expressed concern about obtaining sufficient fill for the project.

Paul Hoffman, Hoffman Construction noted that the proposed hauling of the fill would commence about the first week of May and be completed by mid-July; a period of about 30 working days.  The site should be regraded and seeded by the end of September, 2005.     

It is their intent to haul only on weekdays, Monday through Friday, and during the period of 7:00 a.m. to 5:00 p.m. 

 

Yoerg asked about the route of the proposed haul road.  Hoffman noted that it is their intent to use former Highway 35 as the haul road.  Hoffman noted that most of the fill needed will be on the east side of STH 35 as much of the ramp on the west side was constructed as part of the STH 35 construction project.  Darnold noted that Old Highway 35 is under the jurisdiction of the town of Hudson.  Hoffman noted that they will be required by WisDOT to video the road for conditions prior to commencement of hauling; and they will be required to restore the road, if necessary.

 

Bieraugel asked about dust control.  Hoffman noted that they will use water or if necessary calcium chloride as necessary.

 

Yoerg asked if the trucks would be covered with tarps.  Hoffman stated that tarps will not be used because most of the material hauled will be sand.

 

Hoffman reviewed the requirements of the WisDOT for erosion control and that there is an incentive for the site to be regraded and seeded prior to 9-15-05.  If the site is regraded and seeded prior to mid-September, the DOT will pay for any reseeding that may be necessary; if after mid-September, the contractor is responsible.

 

Gilbert noted that the church located on the south side of Stageline Road conducts a Saturday service, and it would be his desire that the hauling would not be conducted during the period that the church would have services.

 

Moved by Gilbert, seconded by Caruso to recommend approval of a land reclamation / grading permit to permit Hoffman Construction to use the 20 acre site owned by DaMe Properties located north of Stageline Rd. and east of STH 35 to borrow fill to be used in the STH 35 / Hanley Rd. interchange project with the following conditions:

            a)  Hours of operation – 7:00 a.m. to 5:00 p.m., weekdays – Monday through Friday only.

            b)  Dust control shall be utilized particularly on rock exit area to control tracking mud onto the road.

            c)  Submittal of the erosion control plan and site restoration plan as required by the WisDOT.

            d)  Payment of the $2,500 erosion control deposit prior to the commencement of any grading.

            e)  Preservation of trees where possible.

Other matters for discussion purposes.  Bieraugel asked Darnold to set up a meeting to discuss the issue of subdivisions in the extraterritorial subdivision review areas and to inquire about any resource information that may be available to review regarding this subject.
