PLAN COMMISSION
October 25, 2007
Members present: Breault, Burchill, Yoerg, Mailloux, Casanova and Caruso
Others present: Matt and Lisa Briggs, Elmer Gillstrom, Jeff Siewert and Wes Anderson and Denny Darnold.
The meeting was called to order at 7:00 p.m. by Chairman Breault.
Motion by Casanova, seconded by Caruso to approve the
meeting minutes of 10/11/07. Motion carried.
Public hearing and
consideration of an application for a conditional use permit by Matt Briggs for
a vehicle repair garage at 1300 Gateway Circle (presently Indianhead Glass) –
Briggs Auto Service. Breault
reviewed the public hearing notice and asked if anyone in the audience would
like to comment in regard to the application for conditional use permit by Matt
Briggs / Briggs Auto Service. No
comments were received. Motion by Yoerg, seconded by Burchill to close the public
hearing. Motion carried.
Darnold noted that he was contacted by Menards, Inc. and Mondus Motor Sports inquiring about the application and
public hearing. Neither was in
attendance at the meeting. Darnold
stated that Menards did not express a concern, but did want to receive a copy
of the application. Darnold mentioned
that Mark Mondus, Mondus
Motor Sports did note that he was concerned about the amount of on-street
parking on
Matt Briggs stated that the existing pavement area has sufficient space to provide up to 21 off-street parking spaces, 13 to the east / front side of the parcel and 8 to the west or back side. He opined that it would be unusual to have a need for parking on the street. Briggs added that there is adequate lot area south of the building to provide additional off-street parking if needed.
Motion by Caruso, seconded by Yoerg
to recommend approval of a conditional use permit to Matt Briggs / Briggs Auto
Service for a vehicle repair garage at
- Plans must be submitted to address plumbing and HVAC improvements as per the memorandum from Mike Wallace, Building Inspector, dated 10/22/07.
- The conditional use permit will be reviewed one year after occupancy of the building as a vehicle repair garage.

Certified survey map,
creating two (2) one-family residential lots on the south side of
Darnold suggested that the two lots may want to have a stormwater / drainage easement, if the inlet is retained in place to facilitate drainage of one or both of the lots. Jeff Siewert, Parkview Development expressed concern that leaving the stormwater main in place may impact the development of the lots. The plan commission discussed requiring grading plans to be approved for both of the lots, prior to issuance of the first building permit to development of either lot.
Motion by Yoerg, seconded by Mailloux to approve and recommend approval of the two lot
certified survey map as proposed by Parkview Development generally located on
the south side of
- Parkview Development provide a letter of credit for the amount of $18,570 to assure the installation of two sets of sanitary sewer and water utility services and the restoration of street, curb and gutter and boulevard.
- Grading plans to be submitted for approval by the city for both lots prior to issuance of a building permit on either lot.
Motion carried.
Garage sales, limitation of the number of garage sales allowed per residence – Community Development Director. Darnold stated that each year the staff receives one or two calls about residents conducting multiple garage sales from their residences with some on-going for all or most of the summer months. Another issue is that residents use their residences to sell goods under the disguise of a garage sale, thus the residence becomes a commercial use in a residential zoning district. Due to the nature of the residential neighborhood and primarily related to on-street parking the continuous or every weekend garage sale may become a nuisance for other nearby residences. Darnold suggested zoning ordinance amendments should be considered to address the number of garage sales permitted and to provide a definition of a garage sale.
It was agreed Darnold would visit with the city attorney about this issue and forward recommendations to the plan commission. No action was taken.

Other business for discussion purposes only or placement on a future agenda. Mailloux inquired when the next meeting is scheduled. Darnold noted that Thursday, November 8th is the next regularly scheduled meeting date. Two of the commissioners noted that they will not be able to meet that date. Darnold stated that he is waiting for the studies to be completed in regard to the wastewater treatment plant expansion / costs and the Carmichael Road / Vine Street corridor traffic / roadway improvement costs, and it may be until mid-November before those studies are completed and are ready for the plan commission and Common Council for review and consideration. Darnold noted that he will review submittals and determine whether there is a need to meet on November 8th.
Motion by Caruso, seconded by Yoerg to adjourn. Motion carried. 7:25 p.m.
